Acceptable Use Policy
This Acceptable Use Policy ("AUP") is part of the Mailistix Terms of Service (the "Terms") and applies to everyone who uses the Mailistix Software and Cloud Services (together, the "Service"). Capitalized terms have the meaning given in the Terms. If you use the Service for a business or organization, you are responsible for making sure that the persons you permit to use it for your purposes comply with this AUP (Section 10 of the Terms).
The AI Features run on models provided by Google (Vertex AI) and Microsoft (Azure OpenAI). Their usage rules also apply to your use of the AI Features: Google's Generative AI Prohibited Use Policy, Microsoft's Enterprise AI Services Code of Conduct and the Acceptable Use Policy in Microsoft's Universal License Terms for Online Services. This AUP summarizes the rules that matter for the Service; where those policies are stricter, they prevail.
1. General rules
You must use the Service only lawfully, in line with the Terms and the terms of your mailbox provider (for example Google's or Microsoft's terms for Gmail, Google Workspace, Outlook.com or Microsoft 365) and the policies of your organization, and only for mailboxes you are authorized to access.
2. Prohibited email and messaging practices
You must not use the Service to:
- send unsolicited bulk or commercial messages (spam), or messages that violate anti-spam laws such as the EU ePrivacy rules, Section 7 of the German Unfair Competition Act (UWG), the U.S. CAN-SPAM Act, Canada's Anti-Spam Legislation (CASL), the UK Privacy and Electronic Communications Regulations (PECR) or Australia's Spam Act 2003;
- send phishing messages, or messages that impersonate a person, company or authority, or that misrepresent the origin of a message (spoofing, forged headers);
- distribute malware, ransomware, or links to them;
- harvest email addresses or other personal data without a legal basis, or use the Service as a data-mining or scraping tool;
- harass, threaten, stalk, bully or intimidate anyone;
- circumvent the sending limits or anti-abuse rules of your mailbox provider.
3. Prohibited content
You must not use the Service, and in particular the AI Features, to create, send or store content that:
- sexually exploits or endangers children, or any child sexual abuse material — we report such material to the competent authorities;
- promotes or supports terrorism or violent extremism, or incites violence;
- is hateful or discriminates against people on the basis of protected characteristics;
- is non-consensual intimate imagery or sexually explicit content generated with the AI Features;
- infringes intellectual property, privacy, personality or publicity rights;
- is defamatory, fraudulent, or otherwise unlawful;
- facilitates illegal goods or services, self-harm, malicious cyber activity, chemical, biological, radiological or nuclear weapons, or other dangerous activities.
4. Rules for the AI Features
You must not use the AI Features to:
- deceive people about the nature of AI-generated content where disclosure is required by law, or present AI Output as human-made where that would be misleading in context (for example, false claims of expertise, fake reviews, or impersonating a specific real person);
- remove or alter markers that identify content as AI-generated, such as the
X-AI-Generatedemail header, for the purpose of misleading others about whether the content was generated by AI; - generate false or misleading information about elections, public health or other matters of public interest, or content intended to manipulate people;
- make decisions with legal or similarly significant effects on people (for example about employment, credit, insurance, housing, education, or access to essential services) without meaningful human review;
- carry out any use listed as high-risk in Annex III of the EU AI Act (Regulation (EU) 2024/1689), for example filtering or evaluating job applications, evaluating employees' performance or behavior, or assessing creditworthiness — the AI Features are not intended or designed for such uses;
- track or monitor people without their consent, profile or score them in a way that is unlawful or leads to unfair treatment, or infer their emotions or sensitive characteristics (for example health, political opinions, religion or sexual orientation);
- provide medical, legal, financial or other professional advice without review by a qualified professional;
- attempt to bypass, disable or manipulate safety filters, system instructions or usage limits ("jailbreaking", prompt injection against the Service);
- extract, reproduce or disclose system prompts, model instructions or other non-public configuration of the AI Features;
- develop, train or improve a product or service that competes with the Service, or an AI or machine-learning model that competes with the Service or with the models used by the AI Features, with the AI Features or their Output;
- process special categories of personal data (for example health data) of third parties in the AI Features unless you have a legal basis to do so.
5. Security and integrity of the Service
You must not:
- access or attempt to access accounts, mailboxes or data that are not yours;
- access the Cloud Services other than through the unmodified Software, automate requests, or exceed or circumvent rate limits, Credit limits or Plan limits;
- interfere with or disrupt the Service, its servers or networks, including through denial-of-service attacks;
- probe, scan or test vulnerabilities except as permitted by our Vulnerability Disclosure Policy;
- reverse engineer the Software except as permitted by the EULA;
- share your Account with others, or create Accounts by automated means or to abuse trials, bonus Credits or promotions.
6. Reporting abuse
Report violations of this AUP to legal@mailistix.com. Please include enough detail for us to identify the issue. Notices under the EU Digital Services Act can be sent to the same address (see the "Contact points" section of the Terms).
7. Enforcement
If we reasonably believe that you violated this AUP, we may, depending on the seriousness of the violation and acting proportionately (Section 14 of the Terms):
- warn you;
- temporarily restrict the AI Features or other parts of the Service;
- suspend or terminate your Account in accordance with the Terms;
- report unlawful activity to the competent authorities where we are legally required or entitled to do so.
Where the law requires it (for example Article 17 of the EU Digital Services Act), we will give you a statement of reasons that names the restriction, the facts and circumstances it is based on, whether automated means were used, the rule of the Terms or this AUP or the law it relies on, and how you can challenge it. You can object to a restriction at legal@mailistix.com; a person reviews your objection (Section 14.5 of the Terms). Any decision to suspend or terminate an Account is taken by a person.
We do not read your emails to enforce this AUP; we act on reports, on signals from our providers (for example a safety refusal from an AI model or an abuse notice from Google or Microsoft), and on technical signals such as unusual request volumes. See the Privacy Policy for how we process data for security and abuse prevention.
